FINAL UPDATE: December 9, 2024
On Friday, December 6, following the December 6 post below, the Manhattan District Attorney dismissed the Manslaughter 2° charge, leaving only “criminally negligent homicide” for the jury to consider.
Thus, the only question the jury had to decide was, “did Daniel Penny negligently cause the death of Jordan Neely?” They did so about an hour after beginning deliberations today, finding Penny “not guilty.”
This is the end of the case. Prosecutors in New York may not appeal acquittals, so the jury’s verdict brings this case to a close.
