The Trump Campaign's Lawsuit Seeking to Prevent Certification of the Pennsylvania Vote is Completely Without Merit
The Trump Campaign lawsuit filed November 10, 2020 in United States District Court of Pennsylvania, Middle District (Williamsport) seeking to delay certification of the Presidential race. Worth a read.
A few points:
1. The only claim in the lawsuit is a 42 USC 1983 (civil rights) claim based on vote dilution. This is fundamentally wrong, as vote dilution as a legal theory rests upon the Fourteenth Amendment's guarantee of equal protection of law.
2. The "vote dilution" theory is based upon allegation of "illegal votes" that "diluted" legal votes.
3. The lawsuit contains no evidence of "illegal votes," only references to websites making claims, such as "[i]n Montgomery county, a poll watcher overheard unregistered voters being advised to return later to vote under a different name that was registered in the poll book."
4. This lawsuit is without merit and will be dismissed quickly.
